CDL, med cert extended COVID emergency exemptions

In addition to the COVID emergency duty hours exemption that was extended through November, the Federal Motor Carrier Safety Administration has also extended other COVID-related exemptions relating to licenses and medical certificates.

With respect to commercial driver’s licenses, the FMCSA allows, but does not require, states to extend the validity of CDLs that expired on or after March 1, 2020, beyond the maximum allowable period of eight years. Under the waiver, states have the discretion to determine whether, due to COVID-19, there is a continued need to extend the validity of CDLs that expired on or after March 1, 2020. States can now extend the validity of CDLs until November 30. The waiver also applies to business apprenticeship permits that had to be renewed as of March 1, 2020.

The FMCSA also allows states to continue to allow CLP holders to take the CDL proficiency test without waiting 14 days after the CLP is issued.

The agency is also extending the waiver to the requirement that CDL and CLP holders have a medical examination and certification, provided the driver has proof of a valid medical certificate and any required medical deviations issued for a period of 90 days or more and that expired on or after June 1, 2021.
